This is a good bug report. Unfortunately, I'm not going to fix it for 1.2.7.
In order to fix this, the Z-window would need to have some special-case 
functionality to filter all brushes that aren't directly below the Z-checker 
icon. The current codebase doesn't allow this without some major time-consuming 
hacks. This, and the fact that with toggleable XY/XZ/YZ and camera view, the Z-
checker has become deprecated... means it's not worth spending the time to 
solve =(.

Unfortunately for its fans, the Z-checker is dying a slow death.. and is likely 
to be removed sometime soon (if we get round to it) unless anyone can give a 
good reason why not.
