For the company Mandriva, it's not so much about license issues as
patent infringement which opens them up to financial consequences.
Legally they would have to get a license for the patent one way or the
other.  I think it's kind of harsh to call a company a moron for not
wanting to be sued.  Note Redhat (and I think every commercial
distribution out there) has the same policy.
